The trucking company claimed the plaintiff, who was flagging traffic at the time of the impact, should have moved out of the way when he was hit. Attorney Ryan Fisher countered that the truck driver bore the responsibility to exercise proper care and attention around construction workers performing authorized duties on or near the roadway.
As a result of the collision, the plaintiff suffered reflex sympathetic dystrophy (CRPS) — a chronic pain condition affecting the nervous system — and lost most of the use of his injured arm.
